Education Department Finds Failure To Issue Warning In Campus Murder Was Clery Act Violation
"This is the single most serious violation of the Clery Act that we have ever seen in the decade and half history of the law," said S. Daniel Carter of Security On Campus, Inc. (SOC) the non-profit advocacy organization that asked ED to review the case. "The most important requirement of the Clery Act is that students be warned about imminent threats to their safety and failing to do so put their very lives at risk." The Education Department also found six additional violations of the Act including that EMU failed to adopt or publish in their annual Clery Act report a policy on how timely warnings would actually be issued. ED found that failing to adopt this required policy "contributed to the decision not to issue a warning in the murder case." It was also found that EMU failed to properly disclose crime statistics including sexual assaults, failed to include all required policy statements in their annual security report, failed to properly maintain their public crime log and lacked the "administrative capability" required to properly implement the Clery Act. The University has 30 days to respond to the findings and make corrections before a final report is produced later this year. As a part of their plan to come into full compliance with the Act EMU has invited SOC to offer their Jeanne Clery Act Training program to institutional personnel in August.
