Justice Delayed, Justice Denied For Jeanne CleryDear Friends,
District Attorney Morganelli has indicated that the appeal's success will likely be dependent on a similar Pennsylvania case (Horn v. Banks). The Supreme Court set new standards for jury instructions in 1988. At issue is whether those rulings can be applied retroactively. Pennsylvania officials have said the death sentences of at least 30 other death row inmates (including Jeanne's murderer) are in jeopardy. Sorry to have to update you with this upsetting news. At least 437 institutions of higher education have been found in violation of the federal Jeanne Clery Act since it was enacted 12 years ago. The Clery Act requires postsecondary schools to report basic campus security information including campus crime statistics. It is named in memory of Jeanne Clery who was raped and murdered on the Lehigh University campus in 1986. Documents identifying the 437 schools were obtained this week by Security On Campus from the U.S. Department of Education under the Freedom of Information Act. The documents show that at least 137 schools have been found in non-compliance through program reviews, and that another 300 schools were found in violation during audits. Two schools, West Virginia Wesleyan and Virginia Tech, known to have been found in violation during program reviews were not included in the list of schools found in violation through reviews so it may not be complete. The Tennessee Bureau of Investigation and the Knoxville Police Department on Monday identified Bruce Scarborough, 46, as a suspect in the four rapes, and a break-in at a fifth woman's apartment. Scarborough who is serving time in prison for an unrelated burglary and sexual battery conviction was identified using a new state repository of DNA samples taken from convicted felons. His DNA matched evidence taken from one of the crime scenes, was matched to one of the other assaults, and he was identified in a photo line-up by the other victims. Law enforcement authorities expect to charge him in the UT cases in the next few weeks. They also indicated that they believe he may be responsible for other assaults and urged any other victims to come forward. Campus Crime In The News
