	Record $385,000 Fine Sought By Federal Government For Clery Act Violations At Salem International University Salem, West Virginia-In a report released last month, the U.S. Department of Education's Philadelphia regional office recommended that a record fine be imposed on Salem International University for egregious violations of the federal Jeanne Clery Act's campus crime reporting requirements. ED had been alerted to these violations by E.T. Howell, chief of the City of Salem Police Department in February of 2000. The "Final Program Review Determination Letter" details 14 separate fine recommendations, each for the maximum possible fine of $27,500, totaling $385,000. This includes five separate fine recommendations for both failing to report and improperly handling five forcible sex offenses in between 1997 and 1999, the period covered by the review. A separate office within ED, the Administrative Actions and Appeals Division (AAAD), will actually be responsible for imposing any fines which could then be appealed to an administrative law judge. This represents a significant development in the enforcement of the Clery Act as only one prior institution has ever been fined. That school, Mt. St. Clare College in Iowa, faced a fine recommendation of $25,000 and settled for $15,000 in 2000. "This enforcement action sends a very strong signal to other colleges and universities that it is going to be more costly to hide crime on campus than to be forthright and honest about it," said S. Daniel Carter of the non-profit victims' rights group Security On Campus, Inc. "Students need this information to know how to avoid crime on campus, and to be able to pressure their schools to provide adequate safety measures."
