U.S. Dept. of Education Imposes First Ever Six-Figure Fine For Campus Crime Reporting Violations
Salem, WV-In the strongest enforcement action in the 15 year history of the federal Jeanne Clery Act campus crime reporting law the U.S. Department of Education (ED) has imposed the first ever six-figure fine on a college for significantly misrepresenting their crime statistics, and for other violations.
Concluding a nearly five and a half year process, last month ED accepted a settlement with Salem International University, a private school in West Virginia, where the institution will pay a $200,000 fine over the course of the next five years in $40,000 installments. SIU had, according to ED findings, omitted more than 80 crimes, including 5 sexual assaults, and several key security policy statements from disclosures made in the late 1990's. "Our daughter Jeanne was brutally raped and murdered in her dorm room at Lehigh University in 1986 because of what she didn't know about a history of crime on her campus," said Connie & Howard Clery, SOC's co-founders and developers of the Clery Act, in a statement about the fine. "We fought hard to make campuses disclose their crime information so other students wouldn't face the same danger, but until now schools had faced no real punishment if they lied. This new guide "Title IX Requires Colleges & Universities To Eliminate The Hostile Environment Caused By Campus Sexual Assault" was produced as a part of SOC's new Legal Internship program, and written by Holly Hogan a third year law student at Harvard. It is a compilation of key information from federal court rulings, guidance issued by the U.S. Department of Education (ED), and findings issued by ED's Office for Civil Rights as a part of their Title IX enforcement actions.
